1. Professional Identity & Artworks
  • The Artist: All original contemporary abstract artworks showcased on this website are created by contemporary artist Bahar Yusif.
  • Authenticity: Every artwork is a unique, original piece of fine art. Due to the digital rendering of screens, slight variations in color and texture may exist between the online images and the physical artwork.
2. Prices & Payments
  • All-Inclusive Pricing: The prices displayed on the website are for the original artworks and fully include worldwide shipping costs.
  • Currency: All prices are processed in the currency specified at checkout.
  • Payment Authorization: By submitting an order, you authorize us to charge your selected payment method for the full listed price. We reserve the right to cancel any transaction if fraud or an unauthorized payment method is suspected
3. Shipping & Delivery
  • Premium Couriers: Artworks are shipped worldwide via trusted premium international carriers (such as DHL, FedEx, or UPS).
  • Processing & Transit Time: Please allow 3–5 business days for your order to be securely packaged. Once dispatched, estimated worldwide delivery takes 7 to 10 days.
  • Packaging: Artworks are custom-packed for international travel using professional heavy boxes, cardboard, or tube packaging.
  • Tracking: A tracking number will be sent to you upon shipment, allowing you to follow your parcel’s progress in real-time until delivery.
4. Customs, Duties & Taxes
  • Exclusions: The listed purchase price does not include local customs fees, import taxes, or local VAT.
  • Buyer Responsibility: These fees are determined entirely by your country’s customs office upon arrival and will be billed directly to you by the carrier. While many countries levy no import tax on original fine art, you may be responsible for a reduced local VAT.
5. Final Sales & Cancellation Policy
  • All Sales Are Final: Due to the bespoke nature, high value, and complex international logistics of original fine art, we do not accept returns, exchanges, or cancellations for change-of-mind purchases.
  • Pre-Purchase Review: Buyers are encouraged to review all dimensions, specifications, and descriptions carefully before completing a transaction.
6. Damaged Shipments & Insurance Claims
  • Full Transit Insurance: All shipments are fully insured against loss or damage during transit at no additional cost to you.
  • Reporting Damage: If your parcel arrives damaged, you must contact us at your designated contact email within 48 hours of delivery.
  • Required Documentation: To process an insurance claim and secure a full refund, you must provide clear, high-resolution photographs of the damage to both the artwork and the exterior packaging. You must retain all original packaging materials for courier inspection.
7. Intellectual Property Rights
  • Copyright Retention: The purchase of a physical artwork transfers ownership of the canvas to the collector, but does not transfer any intellectual property or reproduction rights.
  • Restrictions: Bahar Yusif retains full and exclusive copyright over all original designs, imagery, and textual content on this website. You may not reproduce, resell, or commercially exploit images of the artworks or website content without express, written permission from the artist.
8. Limitation of Liability
  • To the maximum extent permitted by law, Bahar Yusif Art shall not be liable for any indirect, incidental, or consequential damages resulting from the use of this website, delayed shipping timelines due to courier or customs hold-ups, or the handling of the artwork post-delivery.
9. Governing Law & Dispute Resolution
  • These Terms & Conditions shall be governed by and construed in accordance with international principles of commercial law. In the event of any dispute arising out of or in connection with these terms, we encourage good-faith negotiation. Should an amicable settlement not be reached, any disputes shall be resolved through binding international arbitration in accordance with the rules of the International Chamber of Commerce (ICC).
10. Amendments
  • We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Any changes will become effective immediately upon being posted to this page.
